Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Loud Pictures Gallery website, products, and services (the “Services”). By placing an order or using the site, you agree to these Terms and our other posted policies (Refund/Returns, Shipping, Privacy).

1) Who we are

2) Eligibility

  • You must be at least 18 years old (or have legal guardian consent) to purchase.

  • You agree to provide accurate, current information at checkout.

3) Artwork, editions, and ownership

  • We sell physical fine-art photographic prints (unframed and framed), including Limited Editions (LTD) and Open Editions (OE).

  • Limited Editions are produced in fixed quantities and may include a Certificate of Authenticity. Edition counts and availability may change until sold out.

  • Purchase grants ownership of the physical print only. No reproduction, distribution, or commercial use of the image is permitted without prior written consent. All copyrights remain © Rob Loud (and/or respective rights holders).

  • Color/tonal variation can occur between screens and prints and isn’t considered a defect.

4) Pricing, taxes, and payment

  • Prices are shown in USD and may change without notice.

  • You’re responsible for any sales taxes, VAT, duties, and import fees applicable to your order.

  • We process payments through third-party providers (e.g., Shop Pay / Shopify Payments, and may offer installment options like Klarna/Afterpay where available). Your use of those services may be subject to their own terms.

  • We may refuse or cancel orders suspected of fraud, misuse, or error; if we cancel after you’ve been charged, we’ll issue a refund.

5) Orders, production, and shipping

  • Prints are made to order. Estimated production times are posted on our Shipping page; timelines are estimates, not guarantees.

  • We ship with tracking to the address you provide at checkout. Risk of loss transfers to you upon delivery confirmation by the carrier.

  • For international orders, you’re responsible for any customs clearance and fees.

6) Final sale / damage policy

  • All sales are final. We do not accept returns, exchanges, or cancellations once an order is placed.

  • If your order arrives damaged or defective, email [YOUR SUPPORT EMAIL] with your order number and clear photos of the item and packaging within 7 days of delivery. Keep all packaging. Once approved, we will replace the item and ship to the original address.

7) Availability and mistakes

  • We try to display accurate availability, specs, and pricing; errors may occur. We reserve the right to correct errors and to cancel or refuse orders for any reason.

8) Site content and license

  • All content on the site—including images, text, graphics, logos, and code—is protected by intellectual-property laws.

  • You may not copy, reproduce, modify, display, sell, or exploit any site content without prior written consent.

  • You agree not to scrape, spider, or use automated means to access the Services.

9) Acceptable use

You agree not to use the Services to:

  • Violate any law or third-party rights;

  • Attempt to gain unauthorized access to systems;

  • Interfere with security features or site operations;

  • Upload viruses, malicious code, or engage in fraud.

10) Third-party services

  • The Services may link to or integrate with third-party sites, apps, and services. We’re not responsible for third-party content, terms, or practices.

11) Disclaimer of warranties

  • The Services and all content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of liability

  • To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Services or purchase of products.

  • Our total liability for any claim shall not exceed the amount you paid for the product at issue.

13) Indemnification

  • You agree to indemnify and hold harmless Loud Pictures Gallery and our affiliates, officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

14) Changes to the Services and Terms

  • We may modify or discontinue the Services (in whole or part) without notice.

  • We may update these Terms at any time; updates take effect when posted. Your continued use constitutes acceptance of the updated Terms.

15) Governing law

  • These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules.

  • Venue for any permitted action shall be in the state or federal courts located in Texas.
